By using optimisticmedia.net or any of its subdomains, including the OPTtv streaming service at tv.optimisticmedia.net (together, "the Sites"), you agree to these Terms, which form a binding agreement between you and Optimistic Media LLC. Our Privacy Policy is incorporated by reference. If you do not agree, please do not use the Sites.
An account is optional and free. You must be 13 or older to create one, provide accurate information, and keep your credentials confidential. You are responsible for activity under your account. We may suspend or close accounts that violate these Terms; you may delete your account at any time by contacting us.
The Sites' design, branding, and original content are the property of Optimistic Media LLC. OPTtv also features openly licensed films (for example, Creative Commons works); each title's license and credits are shown on its watch page, and your rights to reuse those works come from their licenses, not from us. All other trademarks belong to their owners.
The Sites are supported by advertising and sponsorships. Sponsor messages and ads are labeled (for example, with an "Ad" badge on OPTtv pre-rolls). Third-party ads are not endorsements, and advertisers are responsible for their own content and offers.
The Sites link to third-party sites and services (app stores, podcast platforms, our shop, content sources). We are not responsible for third-party content, policies, or practices.
The Sites are provided "as is" and "as available," without warranties of any kind to the extent permitted by law, including uninterrupted or error-free streaming. To the maximum extent permitted by law, Optimistic Media LLC's total liability arising from your use of the Sites will not exceed the amount you paid us, if any, in the past 12 months.
You agree to indemnify and hold harmless Optimistic Media LLC and its officers, employees, and agents from claims, damages, or expenses arising out of your use of the Sites or your violation of these Terms.
These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Colorado.
We may update these Terms from time to time. Material changes will be notified via the App or by updating the "Effective" date above. Continued use after changes take effect constitutes acceptance.
